Insurance professionals rely upon these two defenses when faced with an E&O claim – (1) invariable practice, and (2) documentation. Understanding the need to document, what is meant by “good documentation” and the advantage of using disclaimer language are just some of the key points explored in this module.
Risk assessment questionnaires and coverage checklists can play an important role in providing another layer of defense for an agency against some of the more common E&O allegations.
The operations of insurance agencies can vary based on size, representation, and geographic location. Over time agencies have had to adapt their operations because of changes in carrier capabilities and workflows, the implementation of tools like upload/download, and competitive raters. This unit will explore areas in the agency’s daily operations that may open the agency up to an E&O loss.

If you have ever said, “I don’t see color” or “I treat everyone equally”, you may have been displaying unconscious or implicit bias. Becoming aware of how the various forms of this behavior can creep into our personal and professional interactions will help to minimize their impact on decisions we make.
Developing an awareness of the various biases and ways to eliminate them from our interactions with staff, clients, and prospects, will reduce the errors and omissions potential during various risk assessment processes.
